I'm no lawyer, but I would expect that being invited to play for England has no legal protection
But if it is legally employment, and certainly it passes some of the tests, then the protected areas of discrimination, including indirect discrimination apply. Having studied some aspects of employment and commercial law, I have seen many surprising rulings including when attending tribunals on behalf of employers. Would love this area to be tested in law. No

I agree. I've long said that the scenario of denying players opportunities based on where they currently play needs testing under employment law. A clever barrister (and most of them are) could make a good argument of indirect discrimination.

Thankyou BiND.  I was reading that this morning and thinking ''Is this just me, (usually) but isn't this a load of codswollop?''  He keeps arguing against himself, ie 10 teams in England can't equate to more playing time for players but obviously less.  And the French having 14 teams have more players of  quality and experience from whom to choose.  The RFU don't realise that they are losing numbers of rugby fans;  rather, they seem to think that we will transfer our affections to support the remaining 10 ( 9? 8? .....?)  Premiership teams  but NO. It don't work that way.  Quelle dromage.

I think the comments section to the article should make the author think a little!

+1 to Bind comments above, from here at chez fishing. Article seems based on conjecture re "everyone agrees.." Did he ask anyone apart from Baxter? And that the Premiership is regularly touted as the most competitive league?

Personally would look at reverting to 12 teams (gives same number of rounds as at present with 11 clubs, and play the 6 nations over 5 weeks with no breaks. Thereby minimally disrupting the Premiership.

Likewise travel to Sixways (from mid Wales) would cut my travel time by about a hour each way. Parking on the trading estate near Sixways also convenient.
Still don't know if I am entirely comfortable with using Sixways - really feel for Warriors supporters.

I watched the game and could not believe that Dixon played on without reviewing after Hodnet had said to him foul play.
Equally the commentary team said it must surely be looked at. Hodnet however made the mistake of saying that it was no 10 Farrel. Hence the decision to play on?????. If he's cited, which I doubt, he should, given his history of the same offence get a ban well into the 6 nations, but there's the rub.
Until that incident I had thought Dixon (who I generally respect) had been poor and been a little generous to Saracens at just about every 50/50, but that may just be my dislike of the EAs.
Glos supporters must be fuming that Shoulder boy scored the drop goal to decide the match when he should have been off the pitch with, at least a yellow, and probably a red card.
